It should be noted, parenthetically, that the order of inheritance found in later recapitulations of the oral law, having undergone repeated analyses of the kind discussed above, differs in a number of respects from that set forth explicitly in the biblical text.
But, it was objected further, perhaps the eighth commandment is the injunction against stealing property, and Ye shall not steal the injunction against kidnapping. The response of the sages is that one must apply reason to the problem and understand the text in consonance with the thirteen hermeneutic rules in accordance with which the Torah is to be interpreted. In this instance it is the twelfth rule in the system of R. Ishmael, which corresponds to the seventh rule in the system of Hillel that applies.
However, the injunction against stealing is nonspeciﬁc and could refer either to the criminally wrongful misappropriation of property or of the kidnapping of people. The question before the sages was, to which of these does the eighth commandment relate, the theft of property or the theft of people? Why this was a matter of interest will be made clear as we consider how the question is dealt with in the Mekhilta. The sages of the school of R.
